By accessing or using Orca Strength Systems products, software, mobile applications, services, or website located at orcastrength.ca, you agree to these Terms.

Users are responsible for maintaining the confidentiality of their account credentials.

Users may not

• Reverse engineer the software or hardware.
• Attempt to gain unauthorized access to services.
• Share accounts with unauthorized individuals.
• Use the platform for unlawful purposes.

Coaches and Athletes

Orca Strength Systems provides performance monitoring tools only. Orca Strength Systems does not provide coaching services, medical advice, training prescriptions, healthcare services, or performance guarantees. Any coaching relationship exists solely between coaches and athletes.

Magnet and Medical Device Safety

ORCA products contain magnets that may interfere with pacemakers, implantable cardioverter-defibrillators, insulin pumps, neurostimulators, hearing devices, and other implanted or wearable medical devices. Before using, handling, carrying, storing, or positioning an ORCA product near any medical device, consult your physician and the medical-device manufacturer and follow their recommended separation distance. Do not use the product if you cannot confirm that it is safe for your circumstances. Seek prompt medical attention if you experience symptoms or suspect interference.

Assumption of Training Risk

Strength training and athletic activity involve inherent risks, including equipment failure, falls, overexertion, and serious injury. Users are responsible for assessing their health, environment, equipment, technique, and readiness before training. Stop immediately and seek qualified medical advice if pain, dizziness, unusual symptoms, or a possible injury occurs. Minors must use the product only with appropriate adult supervision.

Installation and Intended Use

Users must inspect the product before each use and follow all product instructions, warnings, mounting requirements, and environmental limitations. The sensor must be securely attached in a position that will not create a projectile, pinch, trip, or impact hazard. Do not use a damaged, modified, improperly mounted, or malfunctioning product. Orca Strength Systems is not responsible for loss or damage caused by misuse, unauthorized modification, improper installation, use outside the documented specifications, or failure to inspect and maintain the product.

Measurement and Data Limitations

Sensor readings, estimates, scores, recommendations, and software outputs may be incomplete, delayed, or inaccurate due to placement, calibration, connectivity, movement, environment, user input, or other factors. They are informational tools only and must not be used as the sole basis for medical, safety, return-to-play, load-selection, or other high-risk decisions. Users and coaches remain responsible for exercising independent professional judgment.

Limitation of Liability

To the maximum extent permitted by law, Orca Strength Systems shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to its products or services. To the maximum extent permitted by law, Orca Strength Systems' aggregate liability for any claim shall not exceed the amount paid for the product or service giving rise to that claim during the twelve months preceding the event.

Consumer Rights

Nothing in these Terms excludes, restricts, or modifies any warranty, remedy, liability, or consumer right that cannot lawfully be excluded, restricted, or modified under applicable law. Where a limitation in these Terms is not enforceable, it applies only to the maximum extent permitted by law.
